Rabat – Le Parti de la justice et du développement (PJD) a tenu le gouvernement et son chef pour responsables de la gestion de la loi n° 66.23 relative à l’organisation de la profession d’avocat, appelant les barreaux à reprendre leur activité et à mettre fin à l’arrêt général de la fourniture des services professionnels, à la suite de la publication de la loi au Bulletin officiel et de son entrée en vigueur.
Dans un communiqué publié à l’issue d’une réunion extraordinaire et urgente tenue dans la soirée du jeudi 20 août 2026 sous la présidence du secrétaire général, Abdelilah Benkirane, le secrétariat général du PJD a indiqué que la loi n° 66.23, après l’achèvement des étapes de son adoption, de sa promulgation et de sa publication, est devenue une loi contraignante pour tous et n’est plus un projet soumis à la concertation ou à la négociation.
Dans le même communiqué, le parti a renouvelé ses critiques à l’égard de la méthode adoptée par le gouvernement dans la gestion de cette loi, estimant que celle-ci s’est caractérisée, selon sa position, par l’absence d’une approche participative et par le non-respect des engagements. Il considère que cela a entraîné l’arrêt des services professionnels, la perte de droits et la perturbation du fonctionnement de la justice.
Le parti a également tenu le chef du gouvernement et le ministre de la Justice pour responsables de la gestion de ce dossier, tout en critiquant ce qu’il a qualifié d’« erreurs » commises par le président de la Chambre des représentants lors de la saisine de la Cour constitutionnelle au sujet du projet de loi.
Le parti a expliqué que la Cour constitutionnelle n’a pas pu statuer sur la conformité du projet à la Constitution, après avoir considéré que la lettre de saisine ne contenait pas le texte de loi tel qu’il avait été adopté par la Chambre des conseillers lors de la deuxième lecture.
Le secrétariat général du PJD a réaffirmé son attachement à ses positions antérieures concernant la nécessité de préserver l’indépendance de la profession d’avocat et l’immunité de la défense, considérant que celles-ci constituent, selon sa vision, un pilier essentiel pour garantir le droit d’accès à la justice, le droit à la défense et le droit à un procès équitable, tels que consacrés par les dispositions constitutionnelles et les conventions internationales.
Le parti a indiqué que son groupe parlementaire avait voté contre la loi, justifiant cette position par ce qu’il considère comme l’ignorance par le gouvernement des différents amendements proposés, ainsi que par le non-respect, selon le communiqué, des engagements pris par le chef du gouvernement envers l’Association des barreaux du Maroc.
En revanche, le secrétariat général a estimé que l’adoption de la loi et sa publication au Bulletin officiel ne signifient pas la clôture du dossier sur le plan politique, soulignant que la possibilité de la modifier ou de la changer demeure ouverte sur les plans constitutionnel et juridique.
Le parti a lié cette perspective à la prochaine étape politique, notamment à l’approche des élections législatives, considérant que le Parlement et le gouvernement qui découleront des prochaines échéances pourraient permettre de reprendre le dialogue sur certaines des observations fondamentales soulevées au sujet de la loi.
À la fin de son communiqué, le secrétariat général du Parti de la justice et du développement a salué les avocats pour ce qu’il a qualifié de leur résistance face à la méthode du gouvernement et de leur défense de la dignité et de l’indépendance de la profession.
Le secrétariat général a appelé l’Association des barreaux du Maroc, ainsi que les différents barreaux, les bâtonniers, les avocates et les avocats, à « faire preuve de raison et de sagesse », à prendre en considération l’intérêt supérieur des justiciables et des avocats, et à prendre l’initiative de reprendre le travail et de mettre fin à l’arrêt général de la fourniture des services professionnels.
Le parti a justifié cet appel par la nécessité d’assurer le fonctionnement normal des tribunaux, de préserver les droits des justiciables, tout en tenant compte des intérêts légitimes des avocats et des avocates.
Justice and Development Party holds government responsible for lawyers’ law and calls for resumption of work in the courts
Rabat – The Justice and Development Party (PJD) has held the government and its head responsible for the management of Law No. 66.23 concerning the regulation of the legal profession, calling on bar associations to resume work and end the general suspension of professional services following the publication of the law in the Official Gazette and its entry into force.
In a statement issued following an extraordinary and urgent meeting held on Thursday evening, August 20, 2026, under the chairmanship of Secretary-General Abdelilah Benkirane, the PJD’s General Secretariat stated that Law No. 66.23, after completing the stages of approval, promulgation and publication, had become binding law for everyone and was no longer a draft subject to consultation or negotiation.
In the same statement, the party renewed its criticism of the approach adopted by the government in handling the law, considering that it was characterized, according to its position, by the absence of a participatory approach and by broken promises. It said this had resulted in the suspension of professional services, the loss of rights and disruption to the administration of justice.
The party also held the Head of Government and the Minister of Justice responsible for managing the issue, while criticizing what it described as “mistakes” made by the President of the House of Representatives when referring the draft law to the Constitutional Court.
The party explained that the Constitutional Court was unable to rule on the draft law’s conformity with the Constitution after determining that the referral letter did not contain the text of the law as approved by the House of Councillors during the second reading.
The PJD General Secretariat reaffirmed its previous positions regarding the need to safeguard the independence of the legal profession and the immunity of the defense, considering these, according to its position, to be a fundamental pillar for guaranteeing the right of access to justice, the right to defense and the right to a fair trial, as provided for by constitutional provisions and international conventions.
The party stated that its parliamentary group had voted against the law, citing what it considered the government’s disregard for the various proposed amendments, as well as the failure, according to the statement, of the Head of Government to honor his commitments to the Association of Bar Associations of Morocco.
At the same time, the General Secretariat considered that the adoption and publication of the law in the Official Gazette did not mean that the issue was politically closed, noting that the possibility of amending or changing it remained open from a constitutional and legal standpoint.
The party linked this process to the upcoming political stage, particularly as legislative elections approach, considering that the Parliament and government that emerge from the upcoming elections could make it possible to resume dialogue on some of the key concerns raised regarding the law.
At the conclusion of its statement, the General Secretariat of the Justice and Development Party paid tribute to lawyers for what it described as their steadfastness in confronting the government’s approach and defending the dignity and independence of the profession.
The General Secretariat called on the Association of Bar Associations of Morocco, the various bar associations, bar presidents, female lawyers and male lawyers to “exercise reason and wisdom,” take into consideration the supreme interests of litigants and lawyers, and take the initiative to resume work and end the general suspension of professional services.
The party justified this call by the need to ensure the normal functioning of the courts, safeguard the rights of litigants, and take into account the legitimate interests of female and male lawyers.
