At the beginning of this week, the House of Representatives announced the opening of nominations to elect one member of the Constitutional Court, as part of the procedure to renew the third third of the Court’s members, as confirmed by the Speaker of the House, Rachid Talbi Alami.
This step comes in application of Article 130 of the Constitution, which stipulates in its third paragraph that one third of the members of each category of the Constitutional Court shall be renewed every three years. It is also based on Articles 1, 3, 12, and 13 of the Organic Law governing the Constitutional Court.
Deadline for Submitting Candidacy Files
According to a statement issued by the House of Representatives, the Bureau of the House began receiving candidacy files on Tuesday, January 13, and will continue to do so until Monday, January 26 at 3:00 p.m., which is the final deadline for submission to the Secretariat of the Speaker’s Office.
Required Eligibility Criteria
The same announcement specifies that candidates must have advanced training in law, or recognized judicial, legal, or administrative competence, with at least 15 years of professional experience, in addition to enjoying a reputation for integrity and impartiality.
Components of the Candidacy File
Candidates are required to submit a complete application file including:
- A personal application addressed to the Presidency of the House,
- A detailed curriculum vitae following the approved template,
- Certified copies of academic degrees,
- A recent criminal record certificate,
- Passport-sized photographs,
- A copy of the national identity card.
Review Procedure and Voting
The Bureau of the House of Representatives will be responsible for reviewing the candidacy files and verifying their compliance with the applicable legal and regulatory requirements, before preparing the final list of accepted candidates. This list will be distributed to members of the House at least 48 hours before the plenary session scheduled for the vote.
The election is expected to take place during a plenary session, by secret ballot, in accordance with the provisions of the House of Representatives’ Rules of Procedure.
