Rabat, Morocco – The Government Council, meeting on Thursday in Rabat, approved Draft Decree No. 2.25.386, which sets forth the modalities for applying alternative penalties. This draft was presented by the Minister of Justice, Mr. Abdellatif Ouahbi.
This project comes within the framework of implementing the provisions of Law No. 43.22 related to the application of alternative penalties. It aims to “strengthen the criminal justice system, develop mechanisms for punishment enforcement, reduce overcrowding in correctional facilities, and encourage the reintegration of convicted individuals into society, by adopting more humane approaches in dealing with non-serious crimes,” as stated by the Minister Delegate in charge of Relations with Parliament and Government Spokesperson, Mr. Mustapha Baitas, during a press briefing following the Council meeting.
Mr. Baitas added that the legal text also aims to “implement the provisions of Articles 1-647 and 13-647 of the Criminal Procedure Law, in order to address all aspects related to organizing the powers of the prison administration in monitoring the implementation of alternative penalties at both central and local levels, as well as determining the modalities for managing electronic bracelets.”
The Minister emphasized that the decree aims to “achieve optimal consistency and coordination among various stakeholders, thereby ensuring the efficient application of these penalties.”
In a related context, the Minister indicated that it was decided to postpone the consideration of Draft Decree No. 2.23.152, related to the application of Article 13 of Framework Law No. 97.13 concerning the protection and promotion of the rights of persons with disabilities, to a subsequent government meeting.
The approval of this decree reflects the Moroccan government’s commitment to modernizing its judicial system and adopting innovative solutions to address the challenges associated with prison overcrowding, while promoting rehabilitation and social integration approaches, and considering the human dimension in the application of penalties.
