In an unprecedented judicial step, the Primary Court of Fes issued today, Tuesday, September 2, 2025, the first alternative sentence to custodial penalties, as part of consolidating the philosophy of alternative sanctions introduced by the criminal reform in Morocco.
The ruling number 1795/2025 stated that after deliberations on a misdemeanor case, the court decided to convict the defendants for the acts attributed to them, namely attempted threat with a knife and assault causing injury, with a reclassification of the charges according to Articles 129, 303, 400, 505, and 539 of the Penal Code.
Instead of placing the defendants in custody, the court sentenced each of them to an alternative penalty, consisting of:
- Payment of a fine of 90 dirhams.
- Payment of civil compensation of 500 dirhams to the victim.
- Obligation to perform community service for 60 hours, distributed over six weeks, under the supervision of the Public Prosecution and monitoring by the relevant authorities.
This decision is considered a local precedent, reflecting the judiciary’s orientation towards adopting alternatives to imprisonment, ensuring both deterrence and rehabilitation simultaneously, rather than relying solely on the traditional punishment of incarceration.
The step has attracted wide attention in legal and human rights circles and is expected to mark the beginning of a new path in implementing alternative penalties stipulated in Moroccan legislation, aiming to reduce prison overcrowding and encourage reintegration mechanisms.
