Fez Court of First Instance Applies Alternative Sentence in Assault Case, Replacing 4 Months Imprisonment with Restraining Order Against Victim

In a judicial precedent in Fez courts, the Court of First Instance decided to replace a custodial sentence of 4 months’ imprisonment issued against a defendant charged with assault and battery resulting in temporary disability, with an alternative sentence consisting of:

Prohibiting the defendant from approaching or contacting the victim in any way for a period of 6 months, with an obligation to report periodically to the competent security services, under penalty of immediate execution of the original prison sentence in case of violation.

This ruling comes in application of the provisions of Article 38-1 of the Penal Code (amended by Law 10-21) related to alternative sentences, which allows the judge to replace short prison sentences (less than two years) with alternative penalties such as:

  • Community service
  • Daily fines
  • Restraining order against the victim
  • Electronic or restrictive measures
