In its ruling No. 678, the Criminal Chamber of the Court of Cassation annulled a ruling issued by the Casablanca Court of Appeal against a female student who accused a professor at the Faculty of Graduate Studies in Mohammedia of sexual harassment.
The Criminal Chamber of the Court of Cassation had recently overturned, in its ruling No. 678, the ruling issued by the Casablanca Court of Appeal convicting a student to pay a fine of 20 thousand dirhams and compensation of 100 thousand dirhams for the crime of “defamation” against a university professor.
As a reminder, the student had accused the master’s professor in statements to the media of “sexual harassment of students, including herself.” The mother of three students also filed a complaint. After several hearings, the city court dropped the charges against the professor. But the latter, in turn, filed a complaint against the student based on her statements.
This complaint was initially closed by the prosecution, but after a second appeal filed by the professor’s defence, the student was convicted of two counts of insult and defamation against the university professor. She was then sentenced to pay a fine of 20,000 dirhams and compensation of 100,000 dirhams.
After the new annulment ruling is issued by the Court of Cassation, the case will be heard by a party other than the Court of Appeal that issued the invalidated ruling.
This case received significant media coverage, especially since it occurred shortly after Law 103.13 against violence against women entered into force.
