Fez Court of Appeal Issues Prison Sentences in Public Funds Embezzlement Case Involving Territorial Commune in Moulay Yacoub Province

The Criminal Chamber for Financial Crimes at the Fez Court of Appeal issued judicial rulings on Tuesday in a case involving the embezzlement and misappropriation of public funds within a territorial commune in Moulay Yacoub province. Several defendants were prosecuted while remaining at liberty.

The court convicted the former president of the commune on charges of embezzlement and misappropriation of public funds, sentencing him to one year and six months in prison along with a financial fine of 20,000 Moroccan dirhams, while acquitting him of the remaining charges brought against him.

The court also convicted two other defendants for misappropriation of public funds, sentencing each of them to one year in prison and a fine of 10,000 dirhams, while clearing them of the other accusations included in the case.

In the same case, another defendant was convicted of complicity in the embezzlement of public funds and sentenced to one year in prison and a fine of 15,000 dirhams, while also being acquitted of the remaining charges.

The court further ordered the convicted individuals to jointly bear legal costs and set the minimum level of coercive detention for some defendants in case of non-payment. It also ruled that fines and court expenses be deducted from the bail amounts previously deposited, with the remaining balances to be returned.

Meanwhile, the judicial panel acquitted one of the defendants entirely and ordered the reimbursement of his bail deposit.

On the civil level, the court declared itself without jurisdiction regarding civil claims filed against the acquitted defendant, while accepting the remaining claims in form and ordering the convicted parties to jointly pay compensation of 40,000 dirhams to the affected territorial commune.

This case is part of a broader series of financial crime files currently being examined by Moroccan courts in the context of efforts to monitor the management of public affairs and protect public funds.
