Hisham Belawi: Judicial Jurisprudence Supports Women’s Rights and Enhances Economic and Social Empowerment

Hisham Belawi, the Attorney General before the Court of Cassation and Head of the Public Prosecution, stated that the organization of the international symposium on the topic of “Labor and Contribution” comes at a critical time marked by major reforms and legislations in Morocco, notably the revision of the Family Code led by the Commander of the Faithful, His Majesty King Mohammed VI, may God protect and preserve him. In his speech during the symposium, he emphasized that this phase requires an open judicial interpretation that keeps pace with these societal and legislative transformations.

Belawi explained that the issue of “Labor and Contribution” represents a jurisprudential solution embodying the values of justice and fairness, recognizing the efforts exerted by women in the growth of family wealth. He added that this principle has been established historically through Islamic jurisprudence and Moroccan judiciary, where judicial practice has enabled the recognition of the wife’s rights to her share of assets acquired during the marital relationship, reflecting balance and equity between spouses.

The Attorney General pointed out that Moroccan judicial jurisprudence has demonstrated its capacity to be open and responsive to rapid social and cultural developments, stressing its pivotal role in translating these changes into legislation. He added that empowering women in their various developmental roles strengthens the values of equality and parity within the family, which constitutes the fundamental unit of society, as stipulated in Article 32 of the Kingdom’s Constitution.

In conclusion, Hisham Belawi affirmed that the achievements of Moroccan women would not have been possible without the wise leadership of His Majesty King Mohammed VI, who has spared no effort in supporting and protecting women’s rights and enhancing their legal gains. He recalled that His Majesty’s Throne Day speech emphasized the necessity of full participation of women in development, affirming that women’s rights are not gratuitous privileges but legitimate and legal rights that cannot be relinquished.

He added that this scientific symposium serves as an important platform for exchanging expertise and best practices in the field of women’s empowerment, expressing hope that the discussions would yield constructive recommendations to advance the empowerment process and value women’s status as equal partners deserving of all appreciation and respect. He concluded his speech by wishing all participants success and prosperity in their work during the symposium.
