Behind the Major Mismanagement Issues at the Road Accident Guarantee Fund in Morocco

Abdellatif Wahbi, Minister of Justice, revealed significant mismanagement issues that have plagued the administration of the Road Accident Guarantee Fund over the past years, confirming that the institution had long been unable to perform its assigned duties, both towards the victims and the lawyers representing them.

Wahbi explained during his response to parliamentary questions in a session at the House of Representatives that the fund had been virtually paralyzed, stating: “In the first meeting with the fund’s management, it became clear that no compensations were being paid—neither to the victims, nor to the lawyers, nor even for judicial expenses—at a time when its bank accounts were accumulating billions of dirhams.”

The minister added that the former director of the fund had not responded to complaints from the affected parties, accusing him of neglecting his responsibilities. He said that the management was limited to paying taxes on bank interest without disbursing the legal entitlements to beneficiaries.

Wahbi noted that the accumulation of this situation led several lawyers to resort to legal procedures, resulting in the execution of asset seizures on the fund’s accounts that exceeded 186 million dirhams—funds that had been frozen for years in banks due to the legal disputes caused by non-payment.

After the dismissal of the former director, the Minister of Justice confirmed that the fund began to correct its course, emphasizing that the new management started to settle compensation cases. In 2023 and 2024, 90 million dirhams were paid to the eligible recipients, and during the first four months of 2025, the compensations amounted to 43 million dirhams.

It is worth noting that the Road Accident Guarantee Fund was created to compensate accident victims in cases where the perpetrator of the accident does not have insurance. It was supposed to serve as a mechanism for fairness and solidarity, but recurring reports had previously raised concerns about its limited effectiveness and the management problems hindering its operations.
