The Constitutional Court Announces the Vacancy of the Late Mohamed Benaissa’s Seat in the House of Councillors and Calls for Its Replacement

In a ruling issued by the Moroccan Constitutional Court, it was declared that the seat previously held by the late Mohamed Benaissa, a member of the House of Councillors representing the electoral body of representatives of municipal councils, prefectural, and provincial councils in the Tangier-Tetouan-Al Hoceima region, is now vacant. This decision was based on two letters received from the Minister of the Interior and the President of the House of Councillors, both of whom announced the passing of Mohamed Benaissa on February 28, 2025.

The ruling, numbered 252/25 W.B. and issued in the name of His Majesty the King, stated that based on the Constitution and the organic laws governing the House of Councillors and the Constitutional Court, the decision was made to declare the seat vacant and to call upon the candidate whose name appears immediately after the last elected member on the same nomination list to fill the vacant seat.

The court also ordered that a copy of this decision be communicated to the Head of Government and the President of the House of Councillors, in addition to its publication in the Official Gazette.
