Morocco – The Bureau of the Association of Moroccan Bar Associations held a meeting on April 9, 2026, at its headquarters in Rabat, dedicated to reviewing the outcomes of its meeting with the Minister of Justice regarding the draft Criminal Procedure Law, in the context of monitoring developments related to this legal text in its final version.
Maroc – Le bureau de l’Association des barreaux du Maroc a tenu une réunion le 9 avril 2026 à son siège à Rabat, consacrée à l’examen des résultats de la rencontre avec le ministre de la Justice concernant le projet de loi de procédure pénale, dans le cadre du suivi des évolutions liées à ce texte juridique dans sa version finale.
A statement issued by the Bureau indicated that a positive interaction was recorded regarding several amendments introduced to the draft, particularly those related to guarantees of a fair trial and the strengthening of defense rights. It also praised the level of institutional dialogue that characterized the various stages of the project’s preparation, considering it an indicator of the Ministry’s openness to the components of the justice system.
Un communiqué publié par le bureau indique qu’une interaction positive a été enregistrée concernant plusieurs amendements introduits dans le projet, notamment ceux relatifs aux garanties d’un procès équitable et au renforcement des droits de la défense. Il a également salué le niveau de dialogue institutionnel ayant marqué les différentes étapes de l’élaboration du projet, y voyant un indicateur de l’ouverture du ministère aux composantes du système judiciaire.
In this context, the Association highlighted that this institutional dialogue, in which it participated alongside other stakeholders, constituted an important milestone in building trust among the various actors and contributed to enriching the legal debate on several issues related to criminal justice.
Dans ce cadre, l’Association a souligné que ce dialogue institutionnel, auquel elle a participé aux côtés des autres acteurs, a constitué une étape importante dans la construction de la confiance entre les différents intervenants et a contribué à enrichir le débat juridique autour de plusieurs questions liées à la justice pénale.
However, the statement also emphasized the Association’s continued reservations regarding certain provisions that, according to its wording, did not respond to the visions and demands of the profession’s components, despite being raised during the consultation phases. It noted that the final version of the draft did not include several amendments that had broad professional consensus.
Toutefois, le communiqué a également souligné la persistance des réserves de l’Association concernant certaines dispositions qui, selon ses termes, n’ont pas répondu aux visions et revendications des composantes de la profession, malgré leur soumission lors des phases de concertation. Il a précisé que la version finale du projet n’a pas intégré plusieurs amendements ayant fait l’objet d’un large consensus professionnel.
The Association stressed the importance of continuing institutional dialogue with a view to improving the draft during the legislative process within Parliament, in a way that ensures a balance between the requirements of criminal policy and the protection of defense rights, and meets the expectations of professionals and society.
L’Association a insisté sur l’importance de poursuivre le dialogue institutionnel afin d’améliorer le projet lors du processus législatif au Parlement, de manière à garantir un équilibre entre les exigences de la politique pénale et la protection des droits de la défense, et à répondre aux attentes des professionnels et de la société.
The statement affirmed that the Moroccan Bar Associations, in all their components, will continue to monitor this legislative process, expressing their readiness to engage positively and responsibly in all initiatives aimed at developing the justice system and strengthening trust in institutions, within the framework of respect for legal and institutional rules.
Le communiqué a affirmé que les barreaux du Maroc, dans toutes leurs composantes, continueront de suivre ce chantier législatif, exprimant leur volonté de s’engager de manière positive et responsable dans toutes les initiatives visant à développer le système judiciaire et à renforcer la confiance dans les institutions, dans le respect des règles juridiques et institutionnelles.
The statement concluded by emphasizing that the legal profession will remain a key actor in the justice reform process, through its professional contributions and proposals aimed at enriching public debate on related laws, in service of the public interest.
Le communiqué a conclu en soulignant que la profession d’avocat restera un acteur essentiel dans le chantier de réforme de la justice, à travers ses contributions professionnelles et ses propositions visant à enrichir le débat public autour des lois concernées, au service de l’intérêt général.
