Another Setback for the Polisario in Europe: A Desperate Legal Appeal Against a Trade Agreement Reinforcing Morocco’s Sovereignty over the Sahara

The Polisario Front has filed a new legal appeal before the Court of Justice of the European Union, targeting the trade agreement between Morocco and the European Union that entered into force on 3 October 2025. The agreement includes agricultural products originating from Morocco’s southern provinces.

This legal move comes as part of the separatist front’s continued attempts to challenge the economic partnerships linking Morocco with the European Union, following a series of previous legal initiatives that failed to yield favorable outcomes before European institutions.

According to the Polisario’s position, the agreement in question constitutes—under its interpretation—an “implicit recognition” of Morocco’s sovereignty over its southern territories. European institutions, however, maintain that their cooperation with Rabat is based on clear legal foundations and falls within the framework of an advanced partnership covering several strategic areas, including trade, energy, security, and supply chains.

Supportive European Parliamentary Context

This appeal comes just weeks after a decisive vote in the European Parliament on 26 November, which resulted in the rejection of proposed amendments aimed at changing the designation of origin of Moroccan products from the Laayoune–Sakia El Hamra and Dakhla–Oued Eddahab regions.

The contested text failed to secure the required majority by a margin of just one vote, receiving 359 votes in favor, 188 against, and 76 abstentions, falling short of the 360 votes needed for adoption. Observers viewed this vote as a clear political signal reflecting the orientation of European institutions, consistent with the European Commission’s approach of including the southern provinces within the official geographical scope of trade agreements concluded with Morocco.

According to the same sources, the vote also thwarted pressure attempts led by actors within certain European political currents, with backing from Algeria, seeking to impose an alternative designation on Moroccan products destined for the European market.

Prospects of the Legal Appeal

Several analysts believe that this new appeal is likely to meet the same fate as previous Polisario legal actions before European courts, given Brussels’ commitment to the stability of its partnership with Rabat, its determination to safeguard the legal framework of trade agreements, and its desire to avoid politicizing bilateral economic relations.

In its official positions, the European Union reiterates that its partnership with Morocco remains strategic and multidimensional, while emphasizing respect for established legal procedures within its institutions and ensuring the continuity of cooperation in a manner that serves the mutual interests of both parties.
