The criminal chamber at the court of first instance of Fez sentenced, this Monday, April 29, the two authors of the song “Kobi atay” to two years in prison each with a fine of 500 dirhams.
The criminal chamber at the court of first instance of Fez was convinced that the song contains an explicit incitement of minor girls to debauchery.
The two defendants were prosecuted for “inciting minors under the age of 18 to debauchery or prostitution”. According to article 497 of the Penal Code which provides for a penalty of 2 to 10 years of imprisonment for anyone who excites, promotes or facilitates debauchery or prostitution of minors under eighteen years of age – and incitement or provocation to commit a crime or misdemeanor by electronic means (218-5).

According to the Touche pas à mon enfant association, the song, which has sparked heated controversy, is one of many “indecent” videos/songs, because it includes extracts explicitly inciting the sexual exploitation of minors and their rape.
The association explained in a press release that civil society, human rights organizations and the whole of Moroccan society must come together to fight against the scourge of pedophilia, heal the victims’ wounds and make faced with the phenomenon of rape of children and minors.
In addition to the association’s complaint, the arrest of the people involved in this case was based on a report received by the King’s prosecutor from the judicial police services, as well as on a letter sent by the presidency of the Public Prosecutor’s Office at the King’s Prosecutor in Fez.
