A New Legal Publication by Professor Ali Idrissi Hassani Reinforces the Principles of Prosecutorial Policy and Enhances Fair Trial Guarantees

A new legal book has recently been published by Dar Al-Salam Library in Rabat, titled “Guidelines for Rationalizing Prosecutorial Policy in Moroccan Criminal Law: A Human Rights-Based and Institutional Approach to Strengthening Fair Trial Guarantees.” The book is authored by Professor Moulay Ali Idrissi Hassani, a distinguished native of the city of Fez and a graduate of its renowned university, holding a PhD in Political and Legal Sciences with a specialization in Private Law.

This publication contributes significantly to the Moroccan legal library by offering a deep analytical perspective on prosecutorial policy, closely tied to the principles of a fair trial. It adopts a comprehensive approach that combines human rights, legislative, and judicial dimensions, aligning with the latest orientations of the national criminal policy.

This is Professor Idrissi Hassani’s second book, following the success of his first work “The Future of Public Prosecution in Morocco: Between Concept and Evolution – Independence and Accountability,” which received wide acclaim and quickly sold out. In his new work, the author presents a specialized critical reading of a crucial topic—harmonizing public prosecution policy, particularly its accusatory aspects, with human rights and institutional standards in Moroccan criminal legislation. In doing so, he contributes to both academic and institutional discussions on judicial reform.

This work holds special significance as it forms part of the author’s doctoral dissertation, defended at the Faculty of Legal, Economic, and Social Sciences – Sidi Mohamed Ben Abdellah University in Fez on July 17, 2021. The dissertation was awarded the distinction of “Very Honorable” with special commendation from the examination committee and a recommendation for publication. Titled “Modern Trends in Implementing Criminal Policy in Light of the Independence of the Public Prosecution,” the dissertation reflects the author’s active engagement with pressing legal and human rights issues in Morocco.

In his latest publication, Professor Idrissi Hassani delves into critical issues regarding the compatibility between prosecutorial policy and the legal foundations enshrined by the Moroccan legislator. This is particularly relevant in the wake of the institutionalization of judicial independence and the separation of the public prosecution from the executive branch—an essential step toward establishing accountability, safeguarding rights, and protecting freedoms.

The author emphasizes that prosecutorial policy is no longer merely a mechanism for prosecution, but rather a reflection of the state’s maturity in establishing fair judicial and institutional practices. He advocates for the rationalization of this policy based on clear, rigorous standards that allow continuous assessment of the prosecution authority’s performance, in line with legislative developments—especially with the upcoming adoption of Criminal Procedure Bill No. 03.23.

Professor Idrissi Hassani concludes by affirming that the future of national criminal policy hinges on the role of the judiciary—particularly the public prosecution—in implementing major human rights principles and the provisions of the Moroccan Constitution, thereby promoting an independent and impartial judiciary that aligns with international standards.
