The El Jadida Court of Appeal issued a verdict on Saturday, reducing the sentence of streamer Elyas El Maliki to a three-month suspended prison term, thus lightening the first instance judgment which had sentenced him to three months of imprisonment and a fine of 2000 dirhams.
This case followed a complaint filed by 38 feminist and human rights defense associations, accusing him of inciting discrimination and hatred via electronic means, gender-based discrimination, as well as defamation and insults against women, not to mention accusations of psychological, physical, and economic violence.
During the first instance trial, El Maliki acknowledged his mistakes and publicly apologized to the entire Amazigh community, specifying that his statements were not intended to offend or harm any group of the Moroccan identity.
It’s worth noting that El Maliki, who was the most-watched streamer on YouTube Gaming in 2023, had previously been sentenced to 3 months in prison and fined 2,000 dirhams for inciting online hatred in the first instance trial.
The YouTuber had been found guilty of “inciting hatred and discrimination via electronic means, gender-based discrimination, and disseminating content aimed at harming people’s private lives and defaming them,” in addition to “insults and slander against women and acts of psychological, physical, and economic violence.”
El Maliki had already been sentenced to 4 months in prison and fined 5,000 dirhams in a similar case.
