Government Spokesperson Discusses the Strike Law: A Milestone in Strengthening Constitutional Rights and Regulating Union Practices

In a press conference held on Thursday, December 26, 2024, following the government council meeting, government spokesperson Mustafa Baitas emphasized that the strike law represents a pivotal moment in strengthening constitutional rights in Morocco and regulating union practices. He pointed out that this long-awaited project, dating back to the first Moroccan constitution of 1962, has been the subject of extensive and deep discussions over the decades, particularly in the recent period leading up to its approval.

Baitas explained that the debate surrounding the strike law was characterized by seriousness and responsibility, with the parliamentary committee session witnessing an intensive discussion that lasted from the afternoon until the following morning. He regarded this debate as indicative of the project’s significance, viewing it as a crucial step in regulating the right to strike, which is guaranteed by the constitution, in a way that ensures a balance between protecting workers’ rights and maintaining the continuity of economic activities for businesses.

Baitas also highlighted that the preparation of this law resulted from broad consensus between the government, unions, and employer organizations, reflecting a shared desire to reach a regulatory framework that serves all parties and contributes to strengthening social dialogue. He added that the discussion session in the House of Representatives featured in-depth dialogues and constructive debates, underscoring the awareness of the topic’s importance and the necessity of providing a legal framework that ensures the right to strike is exercised within clear parameters.

Regarding the legislative process of the law, Baitas explained that the project will move to the House of Councillors for further discussions, noting that it could be sent back to the House of Representatives for a second reading if any new amendments are introduced. He also emphasized that the Constitutional Court would review the law, given its status as an organic law affecting fundamental rights and freedoms, highlighting the importance of ensuring its alignment with constitutional provisions.

Baitas concluded his statement by reaffirming the government’s complete openness and readiness to engage with all viewpoints during the discussion of this law. He expressed hope that the project would help strengthen trust among all concerned parties and reinforce the exercise of the right to strike in a way that serves the public interest and supports labor market stability in the Kingdom.
