Rabat – The Administrative Court of Rabat has annulled the election of Al-Kabir Kchichine, president of the National Union of the Moroccan Press, as a member of the National Press Council representing the professional journalists’ category, following a ruling issued on Wednesday after a legal challenge filed by journalist Amine El Khiyari.
In final ruling No. 34, the court accepted the challenge and annulled Kchichine’s election to the National Press Council, with the legal consequences arising from the ruling.
The case dates back to the elections held on September 15, which resulted in Kchichine being elected among the representatives of professional journalists on the Council. The official final results show that he obtained 437 votes, compared with 353 votes for Amine El Khiyari.
According to information related to the challenge, El Khiyari filed a case before the Administrative Court of Rabat on September 17, two days after the elections, raising the issue of Kchichine’s eligibility to run, based on conditions related to the practice of the profession.
The challenge also included, according to published information, arguments concerning Kchichine’s professional status following his retirement from the Al Ahdath Al Maghribia newspaper, as well as information that the claimant said was inaccurate in the candidacy form.
It should be noted that these points form part of the arguments presented by the claimant, as reported in the published information, while the operative part of the announced ruling was limited to accepting the challenge, annulling Kchichine’s election and applying the legal consequences arising from the decision.
The judicial ruling is expected to affect the composition of the National Press Council. The official election results show that Amine El Khiyari was the candidate immediately behind Kchichine in terms of votes within the professional journalists’ category, meaning that implementation of the ruling will depend on the legal and regulatory procedures arising from it.
The ruling comes at a sensitive stage in the process of forming the National Press Council, after the temporary committee tasked with carrying out its functions announced the final results of the elections for representatives of professional journalists on September 16.
