Maroc – Le bâtonnier Hussein Ziani, président de l’Association des barreaux du Maroc, a affirmé que la grève ouverte menée par les avocats est liée à un différend professionnel et juridique concernant certaines dispositions de la loi régissant la profession d’avocat, démentant que cette mobilisation soit dirigée contre l’État ou ses constantes nationales.
Cette position intervient dans le contexte de la polémique entourant la poursuite de la grève ouverte et générale des avocats, après la publication de la loi régissant la profession au Bulletin officiel et son entrée en vigueur, ainsi que les réactions et critiques qu’elle a suscitées au sein de la profession.
Le président de l’Association des barreaux du Maroc a rejeté les interprétations relayées par certains médias algériens concernant la nature du mouvement de protestation, estimant que présenter la grève comme une confrontation avec l’État ou comme un « défi » lancé à celui-ci constitue une lecture inexacte de la nature du différend.
Il a expliqué que le cœur de la contestation porte sur les dispositions de la loi relative à la profession d’avocat, l’organisation de son exercice et sa place au sein du système judiciaire, soulignant que cette question n’a aucun lien avec les constantes nationales ni avec les institutions de l’État.
Ziani a souligné que les avocats marocains n’ont pas besoin, selon ses propos, de démontrer leur patriotisme ou leur attachement aux constantes nationales, rappelant le rôle historique des avocats dans la défense des causes nationales, de l’intégrité territoriale et dans la consolidation de l’État de droit et des institutions.
Il a ajouté que l’engagement des avocats dépasse l’exercice de leur profession pour s’étendre aux organisations professionnelles et aux instances nationales et internationales de défense des droits, considérant que cette présence reflète leur implication dans les questions nationales et relatives aux droits humains.
Dans le même contexte, l’Association des barreaux du Maroc avait déjà affirmé, dans un communiqué de son bureau, que le différend en cours ne constitue pas un conflit entre les avocats et l’État ou ses institutions, mais plutôt un différend professionnel au sein du système judiciaire, dont la profession d’avocat constitue l’une des composantes essentielles.
L’association a également souligné que les avocats sont restés, selon elle, parmi les principaux défenseurs de l’intégrité territoriale, des constantes nationales, ainsi que du processus démocratique et des droits humains au Maroc.
Ces prises de position interviennent alors que la grève ouverte des avocats se poursuit, sur fond de revendications liées aux dispositions de la loi régissant la profession, aux conditions de son exercice et à l’indépendance du barreau, tandis que les discussions se poursuivent entre les instances professionnelles et les parties concernées au sujet de plusieurs dispositions de la loi.
À travers ces positions, l’Association des barreaux du Maroc cherche à réaffirmer le caractère professionnel et juridique du mouvement de protestation et à rejeter toute interprétation qui l’éloignerait de son contexte lié à la loi régissant la profession d’avocat.
Moroccan Lawyers Respond to Algerian Media Interpretations of Strike: Dispute Is Professional and Unrelated to Kingdom’s National Principles
Morocco – Hussein Ziani, President of the Association of Moroccan Bar Associations, said that the open-ended strike being held by lawyers is linked to a professional and legal dispute over provisions of the law governing the legal profession, denying that the protest action is directed against the state or its national principles.
Ziani’s remarks come amid controversy surrounding the continuation of the lawyers’ open-ended and nationwide strike, following the publication of the law governing the profession in the Official Gazette and its entry into force, as well as the reactions and criticism it has generated within the legal profession.
The President of the Association of Moroccan Bar Associations rejected interpretations circulated by some Algerian media outlets regarding the nature of the protest, arguing that portraying the strike as a confrontation with the state or as a “challenge” to it constitutes an inaccurate reading of the dispute.
He explained that the core of the protest concerns provisions of the law governing the legal profession, the organization of legal practice and the profession’s position within the justice system, stressing that the dispute has no connection to the country’s national principles or state institutions.
Ziani stressed that Moroccan lawyers do not, in his view, need to prove their patriotism or commitment to the country’s national principles, recalling the historic role of lawyers in defending national causes, territorial integrity and the rule of law and institutions.
He added that lawyers’ involvement extends beyond the practice of their profession to professional and human rights organizations at both the national and international levels, considering this to be evidence of their engagement with national and human rights issues.
In the same context, the Association of Moroccan Bar Associations had previously stated in a communiqué issued by its bureau that the ongoing dispute does not constitute a conflict between lawyers and the state or its institutions, but rather a professional dispute within the justice system, of which the legal profession is a key component.
The association also stressed that Moroccan lawyers have remained, according to the organization, among the leading defenders of the country’s territorial integrity, national principles, and the Kingdom’s democratic and human rights process.
These positions come as the lawyers’ open-ended strike continues, amid demands concerning provisions of the law governing the profession, the conditions for practicing law and the independence of the legal profession, while discussions continue between professional bodies and the relevant authorities regarding several provisions of the law.
Through these statements, the Association of Moroccan Bar Associations seeks to reaffirm the professional and legal nature of the protest and reject any interpretation that takes it out of the context of the law governing the legal profession.
