The MP representing the Rhamna Province, (A. S), appeared on Friday morning in a state of detention before the criminal cases court in Courtroom 2 at the Marrakech Court of First Instance, to face trial on two charges: fraud and issuing checks without cover.
The public prosecutor at the same court had ordered on Thursday the detention of the MP, a contractor in the construction sector, at the Marrakech Penitentiary Institution, after the two charges were brought against him. The decision to detain followed his arrest on Wednesday evening, just before the start of the semi-final football match between the Moroccan and French teams, after a call from the Royal Gendarmerie in the Sidi Ibrahim Oasis summoning him for questioning regarding a complaint lodged against him.
According to details of the case, the complaint involves checks totaling approximately 800,000 Moroccan dirhams, which the beneficiary—a pharmacy and building materials shop owner—was unable to cash at the bank due to insufficient funds. When confronted with the complaint, the MP confirmed to the Gendarmerie investigators that he would settle the owed amounts. However, during the investigation, the appearance of additional checks with different amounts prompted the public prosecutor to issue an order to detain him and refer him for trial in the criminal cases session.
Sources disclosed that the MP, who owns a company specialized in erecting buildings for real estate developers, has been experiencing increasing financial difficulties since the COVID-19 pandemic. The Russian-Ukrainian war and the rise in building materials prices have exacerbated his financial crisis, rendering him unable to settle his debts. As a result, he resorted to issuing checks to purchase equipment and goods but failed to meet his financial obligations, which led his business partners to file complaints based on the checks that the bank refused to honor due to insufficient funds.
This is the first case of its kind in which a Member of Parliament appears before the judiciary in detention, pending further judicial procedures to resolve the case.
