“Generation 2030” Initiative by the Authenticity and Modernity Party Under Scrutiny: Legal Concerns Over Personal Data Protection

The “Generation 2030” initiative launched by the Authenticity and Modernity Party (PAM) has sparked widespread controversy following criticisms regarding its lack of official authorization from the National Commission for the Control of Personal Data Protection (CNDP). This raises questions about the party’s compliance with laws governing the protection of citizens’ personal data.

According to Law No. 08-09 on the protection of individuals concerning the processing of personal data, all entities, including political parties, are required to obtain CNDP’s approval before collecting or processing any personal information. Violators of this law face penalties, including imprisonment ranging from three months to one year and fines between 20,000 and 200,000 dirhams, making the absence of such authorization a legal concern.

Sources involved in personal data protection have pointed out that failing to take the necessary legal steps could undermine the credibility of the CNDP, particularly if the law is not enforced strictly and equally on all parties.

Observers believe that the lack of a clear statement from the CNDP regarding the initiative’s legal status could impact young people’s trust in political parties’ commitment to their digital rights. Experts are calling for responsible authorities to transparently announce their compliance with licensing requirements on digital platforms to prevent future legal complications.

A senior party official emphasized that these “catastrophic mistakes” stem from the absence of participatory democracy, non-compliance with the party’s code of ethics, and the closed-door approach adopted in its communication with its genuine and non-fictitious base.
