Justice Minister Abdel Latif Wahbi revealed that about 500 individuals have benefited from alternative penalties since the related law came into effect recently. Wahbi stated in an interview with Rue20 during the oral questions session at the House of Representatives on Monday that anyone who fails to comply with the alternative penalty imposed will be returned to prison to serve the original custodial sentence.
Wahbi urged all those sentenced to alternative penalties to implement them without delay, emphasizing that compliance is mandatory and not optional, and failure to do so results in losing the benefit of the alternative sanction.
He added that monitoring the implementation of alternative penalties is the responsibility of the Public Prosecution and the enforcement judge, not the Ministry of Justice, which only holds the organizational and legislative role without direct enforcement of judicial rulings.
During the session, Wahbi stated that Moroccan courts have executed approximately 450 alternative penalties as part of efforts to reduce prison sentences in minor cases and promote alternatives for rehabilitation and reintegration. He pointed out that the alternative penalties experiment is progressing well despite only 9 cases where the convicted failed to perform the required community service without providing acceptable legal excuses.
The minister confirmed that a decision was made today to incarcerate these nine individuals after the legal deadline expired and they failed to respond to the enforcement judge’s opportunities to rectify their status.
