One of the highlighted amendments includes the possibility of formally documenting an anti-polygamy clause in marriage contracts. The minister explained that this proposal allows the wife to stipulate a prohibition on polygamy in the marriage contract, a legal right that can be officially recorded if both parties agree.
The Minister of Justice emphasized that such a condition would be binding for both parties, prohibiting the husband from marrying another wife if the contract includes the wife’s stipulation against polygamy. He described this proposal as a step towards upholding justice and equality between spouses, providing legal safeguards to protect the rights of the wife.
The minister further noted that this amendment is part of a comprehensive review of the Family Code aimed at strengthening women’s rights and ensuring their protection in various aspects of marital life. He also clarified that the absence of this condition in the contract does not imply unrestricted permission for polygamy, which remains limited to exceptional cases determined by the court, such as a health condition or illness preventing the continuation of the marital relationship.
