Rabat – The House of Representatives unanimously approved on Tuesday, December 2, 2025, draft law No. 63.24 amending the old law on compensation for road accident victims, which had remained unchanged since 1984. This reform represents the largest update to the compensation system in four decades and aims to drastically increase compensation amounts and ensure justice for victims and heirs.
Key Amendments in the New Law:
- Increases of Up to 150% in Compensation Amounts
Minister of Justice Abdellatif Ouahbi, during the presentation of the draft law, confirmed that the objective is to raise compensation by up to 150% in some cases, particularly for permanent disability and fatalities. - Raising the Minimum Reference Wage from 9,200 to 14,000 Dirhams
The minimum monthly wage used for calculating compensation will become 14,000 dirhams instead of 9,200 dirhams, with mandatory review every three years according to the economic growth rate, ensuring automatic updates of compensation in line with inflation. - Right to Claim Additional Compensation in Case of “Worsening Harm”
For the first time, the law grants victims or their heirs the right to return to court to claim additional compensation if their health condition deteriorates after the final judgment, something insurance companies had completely refused in the past. - Higher Compensation for Permanent Disability and Death
Compensation will be calculated based on new, more equitable tables, taking into account age, income, and functional disability, which will significantly raise the amounts granted to victims from vulnerable groups.
This reform comes after years of repeated demands from road accident victim associations and lawyers, who considered current compensation “unjust and disproportionate to the extent of suffering and rising treatment costs.” The new law is expected to come into force upon its publication in the Official Gazette, after approval by the House of Councillors in the coming weeks.
This law represents a historic step toward strengthening social justice in the area of road accidents, which claim the lives of more than 3,500 people annually in Morocco.
