Supreme Council of the Judiciary Dismisses Three Judges and Relieves Nine Others of Duties in 2024

Rabat – Moroccan News Agency (MAP) – The Supreme Council of the Judiciary took a series of disciplinary and administrative decisions during 2024 aimed at reforming the judicial system and ensuring professional discipline within the judiciary, according to its annual report. These decisions included the dismissal of three judges and the relief of nine others from their prosecutorial duties by their judicial superiors (five in the January session and four in the September session), based on evaluations of their professional performance and the requirements of sound judicial administration.

The report revealed that a total of 35 judges left the judicial corps during the same year, distributed as follows: 13 retired, 9 entered partial retirement, 3 were dismissed, 1 reached compulsory retirement, 2 ceased work, 5 passed away, and 2 resigned.

The council also decided to relieve 11 judges from certain judicial tasks to which they had been assigned, either at their request or based on proposals from their direct supervisors (7 in January and 4 in September). Regarding complaints, the council examined 93 appeals submitted by judges concerning denied promotions, transfer refusals, or objections to evaluation decisions, approving 13 for valid legal reasons and rejecting 80 due to insufficient grounds.

To ensure continuity of judicial work, the council appointed judges to specialized roles such as investigations, juvenile cases, enforcement of penalties, documentation, family matters, and juvenile affairs after verifying their qualifications. Special appointments also included membership in the Arab Investment Court and advisory roles in the disciplinary bodies of regional councils.

In managing administrative situations, the council approved extending the retirement age for seven judges by two additional years (out of nine cases), based on Organizational Law 106.13, while referring 13 others to retirement and approving nine partial retirement requests, bringing the total beneficiaries from 2021 to 2024 to 40 judges.

Concerning appointments to leadership positions, there were 27 appointments (11.25% of available positions), including 24 male and 3 female judges, with 14 assuming responsibility for the first time (52%). The council paid special attention to gender equality, noting that women represent 27% of judges but hold only 6.9% of leadership positions despite doubling since 2020. A study was launched to investigate the causes of their low participation, aligning with Recommendation 37 of the strategic plan and Article 19 of the constitution, to consolidate parity and empower Moroccan women.

These measures reflect the council’s commitment to enhancing integrity and efficiency within the judicial system, in the framework of constitutional reforms and royal will to achieve effective and balanced justice.
