Agadir, Morocco – In a judicial precedent, the Agadir Court of First Instance has issued the first ruling with alternative penalties in a flagrant misdemeanor case involving participation in alcohol trafficking. This verdict embodies the new direction of criminal justice in Morocco, which aims to modernize the legal system.
The court sentenced the accused to two months of imprisonment and a fine of 500 dirhams, with the prison sentence being commuted to a financial penalty of 300 dirhams for each day of imprisonment.
This verdict is considered the first of its kind in flagrant misdemeanor cases and comes after Law No. 43.22 on alternative penalties came into force. This law allows judges to replace custodial sentences with alternative penalties, with the goal of rehabilitating convicts and easing the burden on correctional facilities.
It should be noted that the new law excludes a number of crimes from eligibility for alternative penalties. These include crimes related to:
- State security and terrorism.
- Embezzlement, bribery, abuse of power, and misuse of public funds.
- Money laundering.
- International drug trafficking.
- Sexual exploitation of minors or people with disabilities.
This ruling represents a significant step towards modernizing the Moroccan judicial system and reflects a desire to adopt a new criminal policy that balances punishment with rehabilitation.
