Benkirane on the family code: “What do they want from us? Especially Moroccans facing corruption and equality between men and women can’t” + (video)

Abdelilah Benkirane, Secretary General of the Justice and Development Party (PJD), warned of the “serious consequences” of some of the proposed amendments to the Family Code, especially those related to preventing the marital home from being included in the inheritance and giving it to the husband or wife in the event of the death of one of them. This measure could lead to serious conflicts and even crimes, he said.

During a rally in Bensliman, Ibn Kirane explained that the Minister of Justice submitted a proposal that the marital home should remain in the possession of the wife if the husband dies, and vice versa if the wife dies, but this approach, according to him, ignores the rights of heirs, including sons, daughters, parents and sometimes family members, such as cousins or siblings, which could create severe conflicts within the family.

He pointed out that depriving children of their legitimate share in inheritance may lead some of them to implicitly wish or even cause the death of a parent to get the house, citing the case of a woman who lived in her deceased husband’s house for 40 years, which prevented her children from disposing of it despite its high value.

He also expressed concern that other heirs, such as the deceased husband’s mother, could be expelled from the house if it is given entirely to the wife, saying that this amendment is “very dangerous” and could open the door to family conflicts and even crimes.

He stressed that the PJD is not opposed to guaranteeing the right of widows and their children to housing, but called for allocating a specific share to them without taking over the entire house, especially in light of the high real estate prices in cities such as Rabat and Casablanca, where their value reaches billions of centimeters.

The party’s secretary-general criticized some feminist demands for absolute equality between men and women, arguing that justice is the basis, not equality in all matters. He explained that men bear the responsibilities of marriage financially, from paying the dowry to supporting the family and bearing the costs of divorce, asking why these burdens are ignored when demanding equality.

Ibn Kiran concluded his intervention by warning that such amendments may lead to the reluctance of young people to marry and the spread of extramarital relationships, calling for a review of these proposals to achieve a balance between rights and duties.
