The first proposal concerns the wife’s right to remain in the marital home after the husband’s death. The minister explained that the new draft law would grant the wife the right to stay in the marital residence until her death. This right would be subject to clear legal conditions to safeguard against exploitation or abuse. The proposal aims to ensure stability and provide a secure environment for the wife after losing her partner.
The second topic addressed the regulation of inheritance-related gifts. The minister referenced a proposal by the Supreme Council of Ulema allowing individuals to allocate a portion of their wealth to certain heirs during their lifetime. This would require a “symbolic possession” as a substitute for actual possession. The proposed law seeks to guarantee fair distribution of such gifts among heirs, including children of all genders. Additionally, it emphasizes the necessity for heirs to establish effective possession of these gifts to make them legally binding, ensuring the fair execution of parents’ wishes and equitable wealth distribution.
