Moroccan Justice Minister Announces Implementation of Alternative Sentences by August 2025

During a parliamentary session at the House of Councillors, Minister of Justice Abdellatif Ouahbi announced that alternative sentences would come into effect in August 2025. This initiative is part of the government’s efforts to reform the justice system and alleviate overcrowding in prisons.

The minister affirmed that all regulatory measures related to these sentences would be finalized by May next year, as per directives from the Prime Minister. A special committee, including representatives from the Public Prosecution Office, Prison Administration, and the Deposit and Management Fund, has been established to oversee the project’s implementation.

Minister Ouahbi explained that alternative sentences aim not only to reduce prison congestion but also to promote rehabilitation and reform among individuals facing judicial proceedings. These measures will include options such as community service and conditional release, enabling offenders to reintegrate into society while adhering to specific conditions.

The minister noted that, while imprisonment serves as a deterrent, it can sometimes have counterproductive outcomes, potentially fostering new criminal behaviors. Consequently, alternative sentences are viewed as an effective tool for providing genuine opportunities for reform without the need for incarceration.

As part of the preparation process, Ouahbi revealed that delegations had been sent to countries such as France, Spain, and the United States to study their experiences with alternative sentencing. Additionally, international organizations have expressed their readiness to support Morocco in this initiative through funding and training programs.

Concluding his remarks, the minister emphasized the importance of a gradual approach to implementing alternative sentences, ensuring the proper training of judges and relevant personnel. He highlighted that this step represents a transformative move towards a more humane and balanced justice system.
