During a communication meeting on Tuesday, December 24, 2024, Minister of Justice Abdellatif Ouahbi outlined significant updates to Morocco’s Family Code concerning divorce procedures and marital property. He highlighted a groundbreaking proposal to make mutual divorce agreements a direct contract between spouses, eliminating the need for judicial intervention. This change aims to expedite the process and reduce tensions between parties.
The minister also stressed the importance of setting a maximum six-month timeframe for resolving divorce and separation cases to streamline legal proceedings.
Regarding marital assets, a new mechanism has been proposed to recognize the wife’s domestic work as a genuine contribution to the wealth accumulated during the marriage. This measure seeks to ensure fairness and acknowledge non-monetary contributions in the division of assets.
In another initiative, the minister emphasized integrating modern electronic tools into divorce cases, such as electronic notifications and accepting power of attorney. However, the reconciliation and mediation phase will require the personal presence of both parties to ensure effective resolution.
