In a communication meeting held on Tuesday, December 24, 2024, in Rabat, Minister of Justice Abdellatif Ouahbi presented the key elements of proposed revisions to the Family Code. These updates aim to modernize and regulate various aspects of marriage while safeguarding individual rights within this framework.
The minister emphasized that one of the most significant proposed amendments is the formal documentation of engagement and the establishment of the marriage contract as the sole legal proof of marital relationships. Exceptions will be allowed for recognizing marital claims in specific circumstances. These changes are designed to enhance marriage guarantees, particularly for persons with disabilities, by revising administrative and procedural requirements to ensure greater transparency and efficiency.
Regarding Moroccans residing abroad, the minister proposed allowing marriages to be conducted without the presence of two Muslim witnesses in exceptional cases, tailored to the unique circumstances of Moroccan migrants. This initiative seeks to facilitate the legal marriage process for expatriates while addressing their specific needs.
On the subject of marriage age, Ouahbi affirmed that the legal age for marriage will be set at 18 full solar years, with exceptions for certain cases where minors aged 17 may marry. These exceptions will be governed by strict conditions to protect individual rights and ensure their application aligns with the public interest.
