Agadir Court Orders Commune President to Include His Dismissal Proposal on the Agenda

The Administrative Court of Agadir has issued a ruling compelling the president of the rural commune of Ait Milk, in the province of Chtouka Ait Baha, to include the proposal for his dismissal on the agenda of the October 2024 session, in accordance with the law. The court also ordered the immediate execution of this judgment.

This judicial decision comes after the commune president, a member of the National Rally of Independents party, refused to comply with the request of two-thirds of the communal council members aimed at removing him from office after losing his majority midway through his term.

According to local media reports, the dismissal proposal is based on Article 70 of the Organic Law of Territorial Communities (113.14), which allows two-thirds of the communal council members to request the president’s resignation after three years in office.

In case of refusal, the law permits the council, with a three-quarters majority, to contact the provincial governor to submit the matter to the competent administrative court and request the president’s dismissal.

This situation reflects similar internal conflicts in several territorial communities in the Souss-Massa region, where elected officials are seeking to overthrow their presidents or disrupt the October sessions dedicated to approving the budget for the following year.
