In a move that has sparked significant controversy, the Spanish Congress has approved the study of a bill proposed by the left-wing Sumar group, which seeks to grant Spanish citizenship to Sahrawis born in the Moroccan Sahara before February 26, 1976. This legislation has raised eyebrows as it contradicts historical facts and the current reality, given that the Moroccan Sahara has always been an integral part of the Kingdom of Morocco.
The bill, which received majority support in Congress, faced strong opposition from the ruling Spanish Socialist Workers’ Party (PSOE), led by Prime Minister Pedro Sánchez, while the far-right Vox party abstained from voting.
The proposed law aims to grant Spanish citizenship through a “naturalization decree”, under Article 21 of the Spanish Civil Code, which allows the government to issue royal decrees granting citizenship without standard administrative procedures. However, this initiative is seen as legally and historically flawed, as it disregards Morocco’s historical and legal sovereignty over the region.
The bill requires applicants to provide documents proving birth in the Moroccan Sahara before the specified date, such as an expired Spanish identity card, registration certificates from the UN census for the Sahara referendum, or documents issued by authorities in Tindouf refugee camps, certified by the Polisario Front. This condition has drawn strong criticism from the PSOE, which rejects reliance on the Polisario Front, considering it an unrecognized entity with no legal legitimacy in Morocco.
Observers view this bill as an attempt to reopen settled issues and undermine Morocco’s territorial integrity, at a time when the international community overwhelmingly supports Morocco’s autonomy plan for the southern provinces under Moroccan sovereignty.
While socialists argue that a model similar to Equatorial Guinea’s nationality process would be more practical, questions remain regarding the true motives behind this bill and its potential impact on Moroccan-Spanish relations.
It remains to be seen how this initiative will unfold, but what is certain is that Morocco will remain steadfast in defending its territorial unity and will not accept any attempts to distort history or challenge its sovereignty.
