In a communication meeting held on Tuesday, December 24, 2024, in Rabat, Minister of Endowments and Islamic Affairs, Ahmed Toufiq, discussed proposals for reforming the Family Code aimed at aligning legal provisions with Islamic law while ensuring the public interest. The minister highlighted that the proposed revisions focus on three main issues: lineage, inheritance, and polygamy.
Regarding lineage outside marriage, the minister emphasized that the proposed alternative solution is to hold the father financially responsible for the child without the need to establish legal paternity, as confirming lineage in such cases conflicts with both Islamic law and the constitution. He explained that this approach seeks to prevent the creation of a substitute family while safeguarding the best interests of the child.
On the matter of inheritance, Minister Toufiq explained that solutions have been proposed to ensure fairness among heirs by using gifts (hibah) instead of a will, in cases where other heirs do not consent. This solution allows individuals to distribute their property according to their wishes, without the requirement for actual possession.
Regarding polygamy, the minister confirmed that an alternative solution has been proposed in line with Islamic principles, ensuring the rights of all wives. This includes not requiring the prior consent of the first wife in cases of polygamy, provided that the issue is addressed in a manner consistent with Sharia law.
