In a communication meeting held on Tuesday, December 24, 2024, in Rabat, Minister of Justice Abdellatif Ouahbi presented significant proposals aimed at reforming the Family Code. The minister emphasized that child custody should be considered a shared right between both parents during their marriage, with the possibility of maintaining this arrangement post-divorce if mutually agreed upon.
The proposals also included strengthening the right to housing for custodial children and regulating visitation rights and travel arrangements for minors.
Minister Ouahbi also addressed the issue of a divorced mother’s custody rights in cases of remarriage, stressing the need to prioritize children’s well-being and stability. Regarding alimony, he called for the establishment of reference standards that account for economic and social conditions, alongside enhanced procedural mechanisms to expedite the enforcement of related judgments.
On the subject of legal guardianship, the minister underlined the importance of making it a shared responsibility between spouses during marriage and after separation, with family courts resolving any disputes that may arise. He further highlighted the need to enhance legal protections for minors, proposing judicial oversight of transactions involving their assets and measures aimed at safeguarding their rights and fostering prudent financial management.
