In a move to put an end to the phenomenon of random well and drilling holes in Morocco, the provisions of Decree No. 2.23.105 have entered into force after its publication in the latest issue of the Official Gazette.
The government council approved this decree in December 2023, which aims to regulate the granting of drilling licenses and specify the conditions for practicing this profession.
With regard to the conditions that must be met by drilling license applicants, the decree stipulates that they must be in a regular situation with regard to tax obligations and social security, as well as having qualified human resources and the necessary equipment.
Among the main conditions that must be complied with by professionals, according to the decree published in the Official Gazette, are the organization of workshops and their equipment with safety means to protect workers and ensure the quality of water resources.
The drilling license holder must comply with a number of conditions, including respecting the terms of the drilling license and organizing workshops in a way that guarantees safety, as well as hanging a sign in the workshops indicating the necessary data and preparing the work site in a way that allows runoff water to be controlled and pollution prevented.
The drilling license is granted by decision of the government authority for a period of 3 years renewable, and the granting process requires the submission of a comprehensive file proving the availability of the necessary qualifications for the safety of people and the environment.
Law No. 36.15 on water indicates that the drilling of wells for the purpose of searching for or extracting water must be restricted to persons who have obtained a drilling license proving their competence.
Morocco hopes to regulate the drilling sector, protect water resources and ensure the safety of workers in this field.
